Welcome to Compassionate Canine ("we," "us," or "our"), a dog training company based in Sidney, British Columbia, Canada.
These Terms of Service ("Terms") govern your access to and use of our website (the "Site"), as well as any services you book or purchase through the Site or directly with us, including consultations, group classes, private training sessions, and related offerings (collectively, the "Services").
By accessing or using the Site, or by booking, purchasing, or participating in our Services, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, do not use the Site or our Services.
We may update these Terms from time to time.
The updated version will be posted on the Site with a revised Effective Date. Your continued use of the Site or Services after changes constitutes acceptance of the revised
Terms.
1. Use of the Site
- You must be at least 19 years of age (or the age of majority in your province) to use the Site and book Services.
- You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site.
- We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes related to dog training.
- You may not: copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content on the Site; use any robot, spider, scraper, or other automated means to access the Site; or interfere with the Site's operation.
2. Services and Bookings
- Description: We provide positive reinforcement-based dog training Services, including but not limited to private sessions, group classes, behavior consultations, and custom plans.
- Bookings: Bookings are made via the Site, email, phone, or in person. A booking confirmation (via email or otherwise) creates a binding agreement subject to these Terms.
- Eligibility: All dogs must be in good health, current on vaccinations (as reasonably required for group settings), and free from contagious conditions. You must disclose any known aggressive or reactive behaviors. We reserve the right to refuse or discontinue Services if, in our reasonable opinion, participation poses a safety risk.
- Cancellations and Rescheduling:
- Cancellations or rescheduling requests must be made at least [48/24] hours in advance (specify your policy).
- Late cancellations or no-shows may result in forfeiture of the session fee.
- We may cancel or reschedule due to illness, weather, emergencies, or other reasonable cause, and will offer a reschedule or refund where applicable.
- Payments: Fees are as listed on the Site or quoted to you. Payments are processed via secure third-party providers. All fees are in Canadian dollars (CAD) and non-refundable except as stated in our refund policy or required by law.
3. Payment and Refund Policy
- Full payment is due at booking or before the first session (unless otherwise agreed).
- We do not store full payment card details.
- Refunds are generally not provided for completed sessions or no-shows. Package deals may have specific refund terms (e.g., pro-rated for unused sessions in certain cases).
- In the event of cancellation by us (other than for client non-compliance), we will offer a full refund or credit.
4. Liability and Risk
Dog training involves inherent risks, including but not limited to injury to persons, dogs, or property. By participating:
- You assume all risks associated with your and your dog's participation.
- You agree that Compassionate Canine, its owners, trainers, and affiliates shall not be liable for any injury, loss, damage, or expense (including veterinary costs) arising from Services, except where caused by our gross negligence or willful misconduct.
- You agree to indemnify and hold us harmless from claims arising from your dog's actions or your provision of inaccurate information.
We recommend consulting a veterinarian before starting any training program.
5. Intellectual Property
All content on the Site (text, graphics, logos, training materials, videos, etc.) is owned by Compassionate Canine or our licensors and protected by copyright, trademark, and other laws. You may not use our content without express written permission, except for personal, non-commercial reference.
6. Third-Party Links and Tools
The Site may contain links to third-party sites or integrate tools (e.g., Google Analytics, payment processors). We are not responsible for their content, privacy practices, or availability. Your use of third-party services is governed by their terms.
7. Termination
We may suspend or terminate your access to the Site or Services at any time for breach of these Terms, safety concerns, or other reasonable cause, without refund except as required by law.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.Any disputes arising from these Terms or the Services shall be resolved exclusively in the courts located in British Columbia. You agree to submit to the personal jurisdiction of such courts.
9. Limitation of Liability
To the fullest extent permitted by law, our total liability to you shall not exceed the amount paid by you for the Services in the 12 months preceding the claim.
We are not liable for indirect, incidental, consequential, special, or punitive damages.
10. Force Majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control (e.g., natural disasters, pandemics, government orders).
11. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
12. Entire Agreement
These Terms (together with our Privacy Policy) constitute the entire agreement between you and us regarding the Site and Services, superseding prior agreements.
